Terms of Service

Taptivais operated by Flare IT Solutions LLC (“Flare IT Solutions,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern access to and use of Taptiva(the “Service”), including the business dashboard, public menu pages, and any related smart links, QR codes, or NFC tags. By creating an account, accessing your business's dashboard, or using the Service, you agree to these Terms on behalf of yourself and the business you represent.

1. The Service

Taptiva lets businesses (primarily restaurants and hospitality venues) publish and manage a digital menu, accessible to their customers via a QR code, NFC tag, or direct link, along with related tools such as analytics, smart links, and printable menu exports.

Accounts are not self-serve. A Flare IT Solutions representative sets up your business's account and sends you an invitation to manage it. You may only use the Service on behalf of the business your account is associated with.

2. Accounts and access

You're responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at goncalo@flareitsolutions.com if you suspect unauthorized access.

Your account only gives you access to the business it's linked to. You may not attempt to access another business's data, account, or dashboard.

3. Subscription and billing

Use of the dashboard requires an active paid subscription, billed monthly in advance through our payment processor, Stripe. Your subscription renews automatically each billing period until canceled.

If a payment fails and isn't resolved, your dashboard access and public menu may be automatically suspended until the subscription is brought current. We don't store your card details — all payment information is handled directly by Stripe.

To cancel, update payment details, or ask about billing, use the billing portal in your dashboard or contact us at goncalo@flareitsolutions.com.

4. Your content

You retain ownership of the content you upload or enter — menu items, prices, descriptions, photos, business information, and similar material (“Your Content”). By submitting Your Content, you grant us a license to host, display, and distribute it as needed to operate the Service, including on your public menu page.

You're responsible for Your Content and for making sure it's accurate and that you have the rights to use it (including any photos or logos). Don't upload content that's illegal, infringes someone else's rights, or is misleading to customers (for example, false allergen or pricing information).

5. Acceptable use

You agree not to:

  • Use the Service for any business or purpose other than the one it was set up for
  • Attempt to bypass, probe, or disrupt the Service's security or infrastructure
  • Use the Service to send spam, malware, or phishing content
  • Resell, sublicense, or white-label the Service without our written agreement
  • Reverse-engineer or scrape the Service beyond normal use of your own dashboard

6. Public menu pages

Your public menu page is accessible to anyone with the link, QR code, or NFC tag — it's not password-protected. Don't include information there you don't want publicly visible (this is why sensitive fields like your Wi-Fi password are only ever shown inside an in-app info panel, not indexed as plain page content).

7. Third-party services

The Service relies on third-party infrastructure to operate, including Stripe (payments), Supabase (hosting and data storage), and Vercel (application hosting). Your use of the Service is also subject to those providers' own terms where applicable.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We don't guarantee the Service will be uninterrupted, error-free, or available at all times.

9. Limitation of liability

To the fullest extent permitted by law, Flare IT Solutions LLC won't be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim arose.

10. Termination

We may suspend or terminate access to the Service for non-payment, violation of these Terms, or if we stop offering the Service. You may cancel your subscription at any time; access continues through the end of the paid period. Upon termination, we may delete your business's data after a reasonable period, except where we're required to retain it by law.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll make reasonable efforts to notify account holders. Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles.
